“GENERAL TERMS & CONDITIONS”:
These terms and conditions are “General Terms & Conditions” for AAA Auction & United Surplus Auctions. These terms & conditions apply to most auctions conducted. However, from time to time, we may conduct auctions that will have different terms, buyer’s premium and/or fees, taxes charged, etc.
Though, the payment method and location to make payments should never change, every auction and seller will have different inspection dates and times and/or item removal dates and times. Please pay close attention to each individual auction’s terms and conditions for any changes or differences from these “General Terms & Conditions”.
All items will be subject to a 10% Buyer’s Fee that will be added to the final bid.
*EXAMPLE…if you bid $500, your total out of pocket purchase price will be $550 / Bid $1,000 = $1,100 / $10,000 = $11,000, etc.
“Special” auctions may have their own unique buyer’s premium or fee.
We may, from time to time, have “special” auctions that have a flat buyer’s fee, such as $100.
*EXAMPLE…you bid $500 your total out of pocket price would be $600 / bid $1,000 = $1,100 / Bid $10,000 = $10,100, etc.

PLEASE DO NOT BID if you DO NOT intend to purchase and pay for the item, if funds are not readily available, or if you are unable to pay within 48 hours after close of auction.
Failure to pay for any auction purchases will result in being permanently banned and bidder will lose all privileges to register, bid and purchase any items from any and/or all of our future auctions.
PAYMENT METHODS ACCEPTED:
• CASH is accepted at our office from 9am – 4pm, up to 48 hours following auction close, unless other arrangements are agreed upon.
Buyer must bring exact change if paying by cash.
A valid driver’s license is required with all cash payments.
DO NOT SEND CASH IN THE MAIL.
• CHECKS – All checks are to be made in U.S. Dollars payable to AAA Auction or United Surplus Auctions.
ALL merchandise will be held and WILL NOT the be released for pick-up until check has cleared bank. NO EXCEPTIONS!!!
A valid driver’s license is required with all payments.
Second/third party checks will NOT be accepted.
• WIRE-TRANSFER: This is our preferred payment method.
Additional $50 wire transfer fee will be added for all International Transfers.
All invoices over $10,000 must be paid by wire transfer, unless other arrangements are agreed upon.

All payments made, including deposits, are non-refundable.
All merchandise is sold AS-IS, WHERE-IS. CONDITION as well as WORKING CONDITION of all merchandise is UNKNOWN and all items are sold only with no warranties or guarantees implied or expressed.
All sales are FINAL.
Each auction and/or Seller will have its own SPECIFIC inspection day/days and times.
AAA AUCTION/UNITED SURPLUS AUCTIONS does our best to accurately describe all merchandise, however, we make no representations on the condition, working condition, usefulness, description errors or omissions, year, make, model, mileage, hours, authenticity, accuracy, genuineness, or any other information on any item or items sold.
AAA AUCTION/UNITED SURPLUS AUCTIONS is an acting agent for the Seller and ALL representations made in print, online, or verbal are made on behalf of the Seller. AAA AUCTION/UNITED SURPLUS AUCTIONS or any of its affiliates will not be held responsible for any act or misrepresentations of the Seller. Any recourse or action must be directed and settled between the Bidder and the Seller.
We highly RECOMMEND and ENCOURAGE every bidder to preview and inspect each and every item BEFORE bidding. ANY and ALL bidding without previewing and inspecting is STRONGLY discouraged.
REMOVAL OF PURCHASED ITEMS:
Each auction and/or Seller will have its own removal day/days and times.
Each Seller will have their own terms regarding removal of items.
All items MUST be removed, without damaging any property, by the advertised deadline, unless other arrangements are agreed upon between the Seller and the Buyer.
If the purchased items are not removed by the advertised deadline or the agreed upon arrangement between the Seller and Buyer, Buyer will forfeit all monies paid and items will be re-listed, re-sold or returned to service without notice and with no recourse.
AAA Auction & United Surplus Auctions are required by Arkansas State Law to fill out ALL titles and paperwork with the appropriate Bidder information.
WE WILL NOT LEAVE TITLES AND PAPERWORK BLANK – NO EXCEPTIONS!
All items are scheduled to close at a specific time. However, we use an AUTO EXTEND or a DYNAMIC CLOSING feature on ALL our online bidding platforms. Therefore, bidding will remain OPEN on any item that receives a bid within a pre-determined time, prior to the scheduled closing time. Every time a bid is placed, a time extension will be added to the original closing time and to each extension closing time.
EXAMPLE…if the pre-determined extension time is set for “5” minutes and an item is scheduled to close at 1pm, and a bid is placed between 12:55pm and 1:00pm, the closing time will be extended by “5” minutes or 1:05pm. If a bid is placed within the next “5” minute interval, then bidding close time will extend another “5” minutes or 1:10pm, etc. When a “5” minute extension interval has passed without any bids, then the item will close and no more bids can be accepted. You may need to frequently, “manually refresh” your browser during the extensions to see all other bids placed and verify you are still the high bidder.
Some auction platforms allow and even encourage “sniping”.
definition of “SNIPING” is… the act of bidding on an item, literally seconds before the auction ends. This prevents anyone from outbidding someone else and eliminates “true” auction bidding.
ELECTRONICS SERVICE INTERRUPTION DISCLAIMER:
All bidders acknowledges and accepts that AAA Auction, United Surplus Auctions and/or any of our affiliates does not guarantee any continuous, uninterrupted service or secure access to our website. It is possible that the operation of this website may be interrupted, interfered with or adversely affected by circumstances and/or factors out of our control. AAA Auction, United Surplus Auctions or any of our affiliates, agents, third party vendors or providers WILL NOT be held liable or WILL NOT be responsible for any loss or damage that may incur in the event of any failure or interruption of the service or internet bidding or from any cause regarding access to, inability to access, inability to place bids, for whatever the perceived cause.
In the event of any service interruption, and/or technical difficulties or circumstances, it will be the sole discretion of AAA Auction, United Surplus Auctions and/or its sellers, to reserve the right to, terminate the interrupted auctions and may declare all bids in those auctions null and void, to allow the auctions to continue to run after the interruption, to re-list and re-start all auctions containing any lots/items that were affected when the interruption occurred, or take any other action deemed necessary. The Auction company’s decision, with the consent of the Seller, shall be final without liability or recourse.
***ALL bidders/buyers agrees, that the act of submitting a bid, constitutes the acceptance of each and every term and condition contained herein, as well as any additional terms and conditions that may be added to the website at a later date. The buyer also agrees that, AAA Auction and/or United Surplus Auctions have the right, but not obligated, to settle any and all disputes, between bidder and seller or bidder and other competing bidders. The buyer agrees to abide by the decision of AAA Auction and/or United Surplus Auctions, whose decision will be fair and final.
